This website is owned, controlled and operated by Fun-Raise USA and is protected by applicable laws, and various other intellectual property rights and laws.

By agreeing to these terms and conditions the fundraiser/fundraising organization and its agent, agree to fundraise with Fun-Raise USA LLC and utilize their products and services to do as such. Fun-Raise USA LLC agrees to provide such services, which are listed and detailed within this agreement.

Definitions throughout this agreement: the terms “we”, “our”, “its” and “us” refer to Fun-Raise USA LLC. The term “Fun-Raise USA” also refers to Fun-Raise USA LLC. The term “Site” refers to the Fun-Raise USA platform and website, its webpages as well as its products and services pertaining to fundraising. The term “you” and “your” refers to you as the Head fundraising agent of your cause/organization and/or the cause/organization in which you are the agent.

You the fundraising agent(s) agree to only use lawful means to fund raise and will not do anything to harm Fun-Raise USA's reputation and will adhere to Fun-Raise USA values when fundraising. Fun-Raise USA does not endorse any events that involve: Violent and/or illegal activity or any behavior or action that does not reflect the culture of Fun-Raise USA.  

Fun-Raise USA is committed to satisfying the fundraising needs of all our clients. We strive to provide a safe, dependable and inclusive fundraising system that maintains excellent service to all our clients. The following are the different services available through our program: Fundraising technology, resources and consulting services. These services include multimedia and answering service capabilities when chosen by the client.

PLEASE READ THESE TERMS AND CONDITIONS OF USE (“TERMS OF USE”) CAREFULLY. BY ACCESSING THIS SITE AND ANY PAGES THEREOF, YOU AGREE TO BE BOUND BY THE TERMS OF USE HEREIN. IF YOU DO NOT AGREE TO THE TERMS OF USE HEREIN, DO NOT ACCESS THIS SITE, OR ANY PAGES THEREOF. NOT ALL PRODUCTS AND SERVICES ARE AVAILABLE IN ALL GEOGRAPHIC AREAS. Ownership and Agreement to Terms of Service Use

This is an agreement between you, your organization and Fun-Raise USA. The terms “we”, “us’, “it(s)” and “our” refer to Fun-Raise USA. The terms and conditions contained in this document shall govern your use of any website or webpage operated by Fun-Raise USA and www.fun-raiseusa.com. Fun-raiseusa.com is the property of Fun-Raise USA.

These Terms of Use apply to Fun-Raise USA the website and webpages operated and located at www.fun-raiseusa.com

FUN-RAISE USA OFFERS THESE PRODUCTS AND SERVICES TO YOU AS A CONDITION TO YOUR ACCEPTANCE WITHOUT MODIFICATION OF THESE TERMS OF SERVICE USE. YOUR USE OF FUN-RAISE USA PRODUCTS AND SERVICES CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS OF SERVICE USE. THESE TERMS OF USE CONTAIN DISCLAIMERS OF WARRANTIES AND LIABILITY AND A DISPUTE RESOLUTION CLAUSE. THESE PROVISIONS PROVIDE AN IMPORTANT OUTLINE TO OUR AGREEMENT.

Fun-Raise USA reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your ongoing responsibility to check these Terms of Use periodically for changes. Your continued use of our products and/or services following the posting of changes will mean that you unconditionally accept and agree to the changes. As long as you comply with these Terms of Use, Fun-Raise USA grants you non-exclusive, non-transferable, limited privilege to enter and use its website for fundraising purposes.

FUN-RAISE USA DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. FUN-RAISE USA DOES NOT WARRANT THE ACCURACY, COMPLETENESS, QUALITY, ADEQUACY OR CONTENT OF ANY INFORMATION OR TOOL ON THE SITE OR ANY OTHER WEBPAGE OR WEBSITE LINKED OR REFERENCED ON THE SITE, NOR DOES FUN-RAISE USA MAKE ANY REPRESENTATION OR WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR ANY OTHER WEBPAGE OR WEBSITE LINKED OR REFERENCED ON THE SITE. THE SITE AND ITS CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. 

ALL INFORMATION PROVIDED ON THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. FUN-RAISE USA CANNOT ENSURE THAT ANY FILES OR OTHER DATA YOU DOWNLOAD FROM THE SITE WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. FUN-RAISE USA DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED. FUN-RAISE USA DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE SITE AND/OR ANY FUN-RAISE USA SERVICES. YOU AND YOUR ORGANIZATION ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SITE AND ANY LINKED SITES. YOUR SOLE REMEDY AGAINST FUN-RAISE USA FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT. THIS LIMITATION OF RELIEF IS AN ESSENTIAL PART OF THE AGREEMENT BETWEEN THE PARTIES. 

The above disclaimer applies to any damages, liability or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, whether for breach of contract, tort, negligence or any other cause of action. Fun-Raise USA reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

Fun-Raise USA does issue the fundraising earnings to the fundraising organization however, it is not responsible for any taxes associated with the earnings issued. Each organization is responsible for its own taxes. Use of the Site shall be governed by all applicable federal, state and territorial laws, as applicable. No information or content from Fun-Raise USA is ever intended to be tax or legal advice. Fun-Raise USA does not provide legal or tax advice. You should review your circumstances with your independent legal and tax advisors, professionals and/or consultants. These Terms of Use shall be construed in accordance with the laws of the State of OHIO and the UNITED STATES of AMERICA and any arbitration or judicial proceedings to enforce or interpret the terms hereof may be brought forth in those state and federal courts.

Service that makes up the platform

E-Commerce Webpage: The Primary Service offered by Fun-Raise USA is a fundraising platform to allow individuals, non-profits and other organizations (the “Fundraising Agent”) to post a fundraiser to the Platform/website in order to accept money and donations from supporters and donors on behalf of the fundraiser. Observe the remainder of the Terms of Service Use to find out more about policies, procedures, rules and regulations of the e-commerce feature of the platform.

The Secondary Service of Platform: 

Automated Answering Service: For those supporters and donors who are not comfortable or do not have the capabilities of supporting or donating through the internet, they can call to support or donate and someone from the Fun-Raise USA staff will contact them to confirm and receive payment. This action will be done through the Platform (the e-commerce webpage) of the fundraiser/fundraising organization receiving the support. 

Fundraisers are given the option to use the automated answering service or not. If you utilize this option, you do so with the understanding that: 1. This Service may not be available in all countries. 2. While an option, Fun-Raise USA is not responsible for ensuring that your supporters/donors have access to this feature at any time. 3. The minimum age of the supporter or donor must be 18 years of age. 4. Inbound Calls are recorded in order to service the orders. 5. Outbound phone calls that are made on behalf of the Fundraiser/Fundraising Organization in order to confirm an order are not recorded. This is for the security of the supporters and donors. 6. No telemarketing will be made on behalf of the Fundraiser or Fundraising Organization. Outbound Calls are only made to confirm and take orders. 7. The Automated Answering Service will be made available 24 hours a day 7 days a week, however in many instances there will be live agent to service phone calls. 8. Phone numbers are kept in a database once an order is made. 9. Payments will be taken by debit or credit card over the phone and you and your supporters/donors agree that they are solely responsible for complying with national, state and local laws, regulations, or rules relating to the personal and financial information that we may collect on your behalf, including any and not limited to a monetary purchase of support or a donation. Any misinformation and/or intentional deceit while exchanging financial information may cause Fun-Raise USA to alert law enforcement. 10. You or your supporters/donors shall not use any language or expression that is unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, indecent, or otherwise objectionable communications or any verbiage that is not seen as reasonable in public, when communicating on or through the Automated Answering Service. 11. Fun-Raise USA will make its best attempt to provide the highest level of service while assisting you in your fundraiser but because miscommunication can occur between your supporters/donors and our service staff, we assume no liability for any mistakes or issues that arise with/from fundraising supporters or donators or any associated with your fundraiser when using the automated answering service. Fun-Raise USA will make its best attempt to keep your supporters and donors satisfied and correct any issues that arise with your fundraiser through our automated answering service. 12. Continuing to use the Automated Answering Service represents and warrants to us that you want to utilize the Automated Answering Service feature, however when you no longer wish to use this option simply convey to your supporters/donors not to call the service when giving support or a donation. Fundraisers have a right to opt out of using or choosing not to use the automated answering service.

Payment Process:  Fun-Raise USA holds funds in a PNC National Bank FDIC Banking Account until they are deposited through PNC bank into the account of the fundraising party. Fun-Raise USA uses PNC Bank as a third-party bank and payment processing partner to process and deposit funds into your Fundraising account. By using the Fun-Raise USA platform you acknowledge and agree that the use of Payment Processing and PNC banking is vital to its products and services and that we exchange information with Banks and Payment Processors in your behalf, in order to facilitate the Platform Services. Fun-Raise USA is not a broker, financial institution, creditor or 501(c)(3) nonprofit corporation or service that provides financial services or advice.

Payment Processing: Fun-Raise USA uses FDIC Banks to process your fundraising dollars and donations for your Fundraiser. You, as the Fundraising Entity, warrant that the account information you have released to Fun-Raise USA is true and that you are authorized to use the account that fundraising monies will be deposited into.

Withdrawals are made through your account and you as the authorized fundraising party is the only party authorized to make a withdrawal through the account. Fun-Raise USA is not responsible for unauthorized withdrawals made from your account.

 Every Wednesday your fundraising commissions and donations are automatically deposited into your fundraising account. For all other withdrawals there will be a small fee of $2.00 per transaction. All withdrawals take 24-48 hours to process and may take longer depending on the policies of your banking institution. 

When you become a member of Fun-Raise USA Fundraising Platform, you acknowledge as the fundraising entity that you accept the fact that monies will be transferred into your account and that you agree to the terms of Service and will disclose the proper information for Fun-Raise USA to transfer the funds into your account. Fun-Raise USA will transfer your funds through PNC NATIONAL BANK which is FDIC insured. 

User Content: With respect to the content that you place onto your fundraising webpage, you represent and warrant that you own all right, title and interest in and to, or otherwise have all necessary rights and consent to the information being viewed by those who visit your webpage and/or fun-raiseusa.com.

By uploading, sharing or providing, content, or any portion thereof, in connection with the services provided by Fun-Raise USA, you hereby grant and will grant Fun-Raise USA nonexclusive, royalty free, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify and otherwise use your Content in connection with the operation of Fun-Raise USA and the promotion, advertising or marketing thereof, in any form. With content containing your name, image or likeness, you hereby release and hold Fun-Raise USA harmless from: all claims for invasion of privacy, publicity or libel: any liability and claim of distortion, alteration, or exploitation of your name, image or likeness.

You waive any right to inspect or approve the finished version of the result of the use of your fundraising Webpage. Further, if any person other than you appears in your user content, you represent and warrant that you have secured all necessary licenses, waivers and releases from such person(s) for the benefit of Fun-Raise USA in a manner fully consistent with the licenses, waivers and releases set forth above. You also acknowledge that your participation in the services and submission of content is voluntary and that you will not receive financial compensation of any type associated with the licenses, waivers, and releases set forth herein and that the sole consideration for subject matter of this agreement is the opportunity to use the fundraising services.

Fun-Raise USA reserves the right to but does not have any obligation to: (a) remove, edit or modify any services, and content, in our sole discretion, at any time, without notice to you and for any reason (including, concerns that you may have violated the Terms of Service), or for no reason at all. Fun-Raise USA reserves the right to remove or block any services and content for any reason. 

Use of the Platform/Website: You agree that in accessing or using the Platform/Website you will not engage in any activities that violate or are contrary to any applicable laws, regulations, or rules in addition to any terms and conditions you may have agreed to with Fun-Raise USA. You agree not to misuse this Site or any content. You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site of Fun-Raise USA. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person's use of the Site. Fun-Raise USA reserves the right to bar you and your organization from our services for any such activity. You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site, or to any of the services offered on or through the Site, by hacking, or any other illegitimate means.

You may not look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other client of Fun-Raise USA, including any Fun-Raise USA account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through this Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own or your organizations information, as provided for by the Site.

The features and services offered on the Site will require you to open an account. (Including setting up a link, username and password to access an account online). You are entirely responsible for maintaining the confidentiality of your applicable account information, including your organization’s link, username, password and for any and all activity that occurs under your account. You agree to notify Fun-Raise USA immediately of any unauthorized use of your applicable link, account or password. You may not use another fundraiser’s/fundraising organization’s link, password or username at any time.

You may be held liable for losses incurred by Fun-Raise USA or any other user of or visitor to the Site due to someone else using your applicable link, username, password or account. You may not use anyone else’s link, username, password or account to access the Site at any time without the legal expressed permission and consent of the holder of such a link, username, password or account. Fun-Raise USA cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Use of the Automated Answering Service 

No Solicitation: The Fun-Raise USA platform/website is offered to help fundraisers raise money. Fun-Raise USA provides the technology to allow fundraisers to connect with their supporters. Our services are not a solicitation of support, but rather assistance in raising funds and donations. By using the services, you understand and agree that Fun-Raise USA is not responsible for the use of your monies after you receive them, or the amount of funds raised for Fundraiser.

Privacy: The Fun-Raise USA website/platform operates under the Fun-Raise USA and Go Daddy private policy as well as terms of service and is protected by (Google’s) reCAPTCHA. These applicable Terms of Service Use, private policy and applicable online security and online privacy practices apply to use of the Site and all fundraising practices, and its terms are made a part of these Terms of Service Use. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure unless the proper security is met by all parties. 

You, the agent and the cause/organization understand that the information including but not limited to links, passwords, and usernames is not to be shared or used with any other persons. Fun-Raise USA is not liable or responsible if your information is stolen or used against your will.

You acknowledge and agree that certain amounts of your personal information will be shared with your supporters and those that donate, as well as those who visit your webpage and those that visit the Fun-Raise USA platform. Fun-Raise USA is not responsible, and shall not be liable, for any Fundraisers information.

Organizers: You, as a Fundraiser agree and warrant that: all information you provide in connection with your fundraiser with Fun-Raise USA is accurate, complete, and not likely to deceive Fun-Raise USA nor its users, viewers or anyone who visits Fun-Raise USA and that you will post updates as needed so that users understand your use of funds and any other relevant information about your Fundraiser.

All donations contributed to your fundraiser will be used solely as described in the materials that you post and provide; if you withdraw donations believed by supporters and donors to be raised on behalf of someone other than you (the beneficiary of the fundraiser). all donations will be given to and/or spent on behalf of the Beneficiary. You shall not infringe the rights of others and you will comply with all relevant and applicable laws and financial reporting obligations, including but not limited to, laws and obligations relating to registration, tax reporting, political contributions, and all other categories of fundraising.

When you share with us any personal data of any third party for any reason, including the names, phone numbers and email addresses of your personal contacts, you have the authority, as required under applicable law, to provide us with such personal data and allow us to use such personal data for the purposes for which you shared it with us. You as a fundraiser may sell goods and services from the fundraiser to your supporters however, you will not provide or offer to provide goods or services in exchange for donations. You authorize Fun-Raise USA, and they reserve the right to provide information relating to your fundraiser to potential supporters, supporters, potential donors and donors, those that benefit from your fundraiser or law enforcement and/or other authorities, to assist in any investigation of you or your actions.

If you use the services as an agent of a charity/organization to raise funds for such, you legally represent and warrant that you are a representative of the charity/organization and authorized to raise funds on behalf of the charity/organization and bind the charity/organization to these Terms of Service Use; you are raising funds for a charity/organization, with a cause that is legal under all applicable federal, state, provincial, territorial county and local laws and regulations. All funds fundraised will be used solely for the purpose that you have stated on and in connection with your fundraiser, and under no circumstances may you use the funds for any other purpose. Your non-profit charity/organization must maintain tax-exempt status under applicable law.

Registration: You may be required to register with Fun-Raise USA to access and use certain features of the services. If you choose to register for the services, you agree to provide and maintain true, accurate, current and complete information about yourself, or your organization as prompted by the registration form. Organizers must register using their true identities (or the identities of their organization authorized representatives), including their name, address and any image or video purporting to depict the organizer of the fundraiser. You agree to keep registration information current and up to date. Registration data and other information is governed by the Terms of Service Use. 

If you are under 18 years of age you are not authorized to use the Fun-Raise USA platform unless you are accompanied/registered with an adult who must put the fundraiser in their name. If Fun-Raise USA at any time discovers that the information you provided about you or the purpose of your fundraiser is incorrect or violates any Terms of Service Use, your access to the services may be immediately suspended and/or terminated and penalties and/or fines may be applied by the authorized authorities, which in all cases, would leave you responsible.

Supporters and Donors: All fundraising monetary support and donations are at the risk of the fundraising supporter or the donor. When fundraising support or a donation is made through the Platform, it is the supporter or donors’ responsibility to understand how the money will be used. Fun-Raise USA is not responsible for any offers, promises, or promotions made by fundraisers. Behavior that does not reflect monies going toward the expressed cause of the fundraiser violates the Terms of Service Use. Fun-Raise USA will not verify or back the information that fundraisers provide, nor do we guarantee that the donations will be used in accordance with any fundraising purpose prescribed by the fundraiser or in accordance with applicable laws. Fraudulent activity and the misuse of funds will be reported immediately to the proper authorities. If you have reason to believe that a fundraiser is not raising or using the funds for their stated purpose, please alert our team of this potential matter and it will be investigated. 

Fun-Raise USA makes no representation as to whether all or any portion of your donations, including, if any, transaction fees, are tax deductible or eligible for tax credits. Fun-Raise USA has no liability for any claim by any federal, state, provincial, territorial, local or any other tax authority with respect to any applicable tax return of any donation by you, any fundraiser or any organization.

You acknowledge and agree that, in accordance with our Terms of Service Use, certain of your personal information will be shared with the organization to which you donate, including without limitation, as part of the donor’s log and may be used by an organization to issue official donation receipts and in accordance with the organization’s privacy policy. Fun-Raise USA is not responsible, and shall not be liable, for any persons/organizations use of any supporter’s or donor’s information.

PROHIBITED CONDUCT

Sales and Content Prohibited on the Platform:  You are not permitted to offer any good or service in exchange for a donation on the platform. As a fundraiser you are responsible for operating your fundraiser in compliance with all applicable law Federal, state or local, in relation to your Fundraiser and/or the use of the Services. You are solely responsible for all User Content that you upload, post, publish, display, transmit or otherwise use. You are also responsible for ensuring the funds raised are used for the purpose stated in your fundraiser. If you are not the registered fundraiser, you agree to deliver funds to the registered fundraiser as soon as possible. 

You are not to upload or take part in any user content that is illegal or prohibited by Fun-Raise USA. Fun-Raise USA reserves the right to remove any fundraiser and/or investigate any user who, in our sole discretion, violates any of the Terms of Service Use. If we investigate your fundraiser, we may review all available material including but not limited to social media, related news, and any other information that we, in our sole discretion, consider relevant in our review. We further reserve the right, without any limitation, to disable your use of the services, remove the offending user content, suspend or terminate the account, end or freeze payments to your fundraiser and report you to law enforcement. 

As a fundraiser you agree:

Not to collect or provide funds for any purpose other than what is described in your fundraiser description.

Not to promote or publicize content that causes reputational harm to any person.

Not to conduct any activity that Fun-Raise USA may deem to be unacceptable or objectionable; restrict or inhibit any other person from using the services; or expose Fun-Raise USA and any of its associates to any harm or liability.

Not to infringement upon the trademark, patent, copyright, trade secrets, or proprietary or privacy rights of Fun-Raise USA or any of its affiliates.

Not to take part in the unauthorized sale or resale of goods or services not authorized and sold by Fun-raise USA.

Not to use, upload or in any way use offensive, graphic, perverse or sensitive or sexual content while fundraising with Fun-Raise USA or on its platform.

No promoting of violent weapons guns, knives, explosives, ammunition, firearms, or other weaponry or accessories.

Not to fund any illegal, criminal, perverted or otherwise unacceptable behavior or actions.

Not to promote drugs, narcotics, pharmaceuticals or similar products that are either illegal or prohibited. 

Not to promote “get rich quick schemes”, investment opportunities or any other financial services. This also includes but is not limited to, network marketing and referral marketing programs.

Not to receive or grant cash advances or lines of credit to yourself or to another person or purposes other than those purposes clearly stated in the fundraiser.

Not to sell or promote other licensed materials without the appropriate authorization. You the fundraiser assume all liability if you do so.

Not to promote any election campaign unless it is fundraising through Fun-Raise USA.

Not to collect payments on behalf of merchants. 

Not to make any attempts to circumvent the designated method of payment as provided by Fun-Raise USA.

Not to fundraise for the legal defense of a violent or inhuman crime.

Not to fundraise for or promote gambling, gaming and/or any other activity with an entry fee and a prize including, casino games, sports betting, fantasy sports, horse racing, and other ventures that involve gambling. Raffle tickets may only be promoted if sanctioned by Fun-Raise USA.

Not to fundraise for or involve your fundraising activities with, in, or involving countries, regions, governments, persons, or entities that are subject to U.S. and other economic sanctions under applicable law. 

Not to use content that reflects, incites or promotes behavior that we deem, intolerant or an abuse of power relating to race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender, gender identity, disabilities or diseases or in support of terrorism, hate, violence, harassment, bullying, discrimination or any crime.

As a fundraiser you agree not to use the services of Fun-Raise USA to raise funds or establish or contribute to any fundraiser with the purpose of or involving:

A. The violation of any law or regulation.

B. Fraudulent, misleading, or dishonest fundraising.

C. The undertaking of any activity or engaging in any conduct that is not consistent with the business or purpose of the services; or

D. The creation of any liability for Fun-Raise USA or cause Fun-Raise USA to take a loss in any way with the services of our Internet Service Provider(s), web hosting company or any other vendors or suppliers.

E. The unauthorized access to the services, or any account, computer system, or network connected to the services, by any unauthorized or illegal means.

F. Using the services to exploit any information, software or in any other way other than fundraising activities in accordance with the Terms of Service Use.

G. The uploading of any user content that: (1) Contains viruses or any entity aimed to interrupt, destroy or limit the functionality of Fun-Raise USA and/or its platform (2) Creates a privacy or security risk to any person; (3) infringes any intellectual property or proprietary rights of any person; (4) Promotes unauthorized advertising of any sort.

H. The use of the services on behalf of a third party.

I. The posting of any personal data or other information about a third party, without the express consent of that third party.

J. The raising of funds for a minor without the express permission of the minor’s guardian.

K. Not to attempt to obtain any materials or information not intentionally made available through the Services.

L. Impersonate any person or entity in any way. 

M. The disobeying any policies, procedures or requirements of Fun-Raise USA and its platform/services.

N. The use of another person’s account, account link, website link, password or URL without their express permission.

Concerning all Support and Donations made through the Fun-Raise USA Platform, you agree:

1. Not to make or accept any donations that you know or suspect to be erroneous, suspicious or fraudulent. 

2. You agree to fully cooperate with any investigation by Fun-Raise USA, for any alleged wrongdoing or alleged wrongdoing.

3. You as the fundraiser must maintain copies of all records related to fundraisers and donations as necessary. Fun-Raise USA does maintain records; however, this does not affect or limit your obligations to maintain documentation as required by applicable laws, rules, regulations, or governmental authorities. 

4. Not to use the services in behalf or for the benefit of any person or entity who is not legally allowed to benefit from these services by the United States of America.

5. Fun-Raise USA reserves the right to refuse, condition, or suspend any support or donations or any transactions that we believe may violate these Terms of Service Use or harm the interests of our users, business partners, the public, or Fun-Raise USA, or that expose you, or others to damaging risks. 

We may share any information regarding your use of our platform and services with the appropriate financial institutions, authorities, or law enforcement agencies consistent with our Terms of Service Use. This information may include information about you, your account, your Supporters/Donors, the monies you receive, and transactions made through or in connection with your webpage and fundraising campaign.

 SUPPORTER AND DONOR CONDUCT

Support and Donations: In order to support or contribute to a fundraiser or to an Organization/Charity, a Supporter/Donor will be required to provide Fun-Raise USA with information regarding the Supporter/Donor’s credit card and/or other payment instruments. You, as a Supporter/Donor, represent and warrant to Fun-Raise USA that such information is true, current and accurate and that you are authorized to use the credit card or payment instrument. You agree that a certain minimum donation amount may apply, and that all support and donations are final and will not be refunded unless Fun-Raise USA agrees to issue a refund. Supporters and Donors acknowledge that by contributing to the fundraiser, the Supporter/Donor agrees to the processing, use, transfer or disclosure of data by Fun-Raise USA to these Terms of Service Use as well as all applicable terms set forth by Fun-Raise USA and the Banks that it uses for processing payments.  

Holds on Account: Fun-Raise USA may place a hold on a fundraiser account (a “Hold”), restrict withdrawals and/or transfer of funds raised to the fundraising party, initiate a reverse ACH transfer, secure reserves, or take similar actions to protect its interests and those of its Fundraisers (Users). Some of the reasons that we may take such actions include, but are not  limited to, our belief or determination, in our sole discretion, that: 1. The information provided by a fundraising party is false, misleading, or fraudulent, or funds are being used in a prohibited manner; 2. If the funds available go to a person other than the fundraising party listed with Fun-Raise USA; 3. A Fundraiser has violated the Terms of Service; 4. The Fun-Raising Party is colluding with others to engage in fraudulent activity; 5. There may be suspicious or fraudulent fundraising or donation activity; 6. An action is required to comply with a court order, subpoena or as otherwise required under applicable laws and regulations. Withdrawals from your account: While Fun-Raise USA works to make withdrawals available to you as soon as possible, you acknowledge and agree that: Withdrawals may not be available to you immediately; Fun-Raise USA does not guarantee that withdrawals will be available to you within any specific time frame but does attempt to make weekly deposits into your account.

Fun-Raise USA disclaims all responsibility for any delay in any withdrawals or your inability to access and use fundraising monies or donations at any specified time, and any consequences arising from such delay or inability. You, as the fundraising party, are responsible for ensuring that the information you provide to Fun-Raise USA in order to process a withdrawal, including bank account information, is accurate and up to date. Fun-Raise USA may, at any time, for any reason, without notice, and in its sole discretion, offer or issue a refund of fundraising monies and/or donations with or without consulting with you, which could add up to the entire amount of your fundraiser. Fun-Raise USA is not liable to you or to any third party for any claims, damages, costs, losses, or other consequences caused by Fun-Raise USA issuing refunds, including, but not limited to transaction or overdraft fees.

Transaction Fees: There are no fees to start or maintain a Fundraiser through Fun-Raise USA, however a transaction fee, including credit and debit charges, is deducted from each fundraising purchase and donation. Compensation: Fun-Raise USA does not guarantee that a fundraiser will obtain a certain amount of money at any time. We do not endorse any Fundraiser, User, or Cause and we make no guarantee that any information provided through our services is accurate. We denounce any liability or responsibility for the outcome or success of any fundraiser. 

All information and content provided by Fun-Raise USA relating to the products and services is for informational purposes only, and Fun-Raise USA does not guarantee the accuracy, completeness, timeliness or reliability of any such information or content.

The compensation that is paid to each Fundraiser/Fundraising Organization will be the agreed upon earnings that are listed with the specific fundraiser chosen by the Fundraiser/Fundraising Organization. For safety purposes monies will be collected by Fun-Raise USA on behalf of the fundraiser through internet and world wide web capabilities. This method of collecting money eliminates most mistakes, theft and other negative consequences that arise from cash handling.  In some cases, cash handling will be needed to receive support from those supporters who may not feel comfortable purchasing through the internet.  When this is the case, we recommend that you the Fundraising agent be responsible for the cash and money handling of the fundraiser.

All funds collected person to person by the Fundraiser/Fundraising Organization should be collected as listed:

Collect the cash from the Supporter/Donor, then make the purchase on behalf of the Supporter/Donor. The Fundraiser/Fundraising Organization can simply deposit the monies into its own bank account, total up all purchases, then place the order through its own fundraising webpage for the number of products/services that were purchased. After all monies and commissions have been calculated the Fundraiser/Fundraising Organization shall receive the agreed upon earnings, by way of ACH (transfer). 

Fun-Raise USA reserves the right to withdraw from this agreement with any Fundraiser/Fundraising Organization should it be necessary to protect its reputation. In this situation, the fundraiser will terminate, and all money raised will be deposited into the account of the fundraiser. 

All Fundraisers/Fundraising Organizations shall receive their fundraising commissions at no cost, automatically, every Wednesday. Deposits are made to the account of the Fundraiser on Wednesdays of every week. After the free deposit, Fundraisers will be charged $3.00 per deposit unless it occurs on Wednesday. 

Shipping: All orders will be shipped to the fundraising party within 3-5 business days, to be distributed to the proper supportive party. Any mistaken or defective orders must be returned to Fun-Raise USA within 3 business days to be replaced or reissued. This ensures that you the fundraiser and/or your supporters receive their proper order in a timely manner.   

Taxes: Fun-Raise USA provides no (legal) representation whether a supportive purchase or donation is tax deductible or will receive tax credits. Fun-Raise USA does not give tax advice. If you need tax advice, you should contact a tax professional. Fun-Raise USA has no liability or responsibility for any taxes of the fundraising party or the person(s) providing the fundraising support through purchasing or donation, whether federal, state, local, sales or any other.

It is your responsibility to determine what, if any, taxes apply to the donations you receive through your use of the Services. It is solely your responsibility to assess, collect, report or remit the correct tax, if any, to the appropriate tax authority. Fun-Raise USA does not withhold funds for tax purposes or otherwise. Fundraisers and/or organizations will be solely responsible for their own taxes based on applicable international, federal, state, local or any other taxes or levies, or for any applicable taxes based on their net income or gross income.

Public Content by the User: As far as information and content offered on your webpage with Fun-Raise USA, some of your activity on and through the services is public, such as or including wording, texts, music, sounds, information, graphics, comments, photos, videos, images, trademarks, logos, brands or other materials you upload or post through the service. Fun-Raise USA may also use this content to promote itself and its services. Your user profile information, including your first and last name, public email address, organization, personal biography, organization biography and other information you enter in connection with your profile, may be displayed to others.

Personal data regarding you and your cause may be accessed by others who view the Fun-Raise USA site. Please remember that if you choose to provide any information, individuals who read this information may use or disclose it to other entities without our knowledge and without your knowledge, and search engines may also store and display that information. Be cautious about including any information you may deem private. Fun-Raise USA may collect, use, and store certain information about you and your fundraising cause.

Supporter or Donor Information. Fun-Raise USA also will have access to your supporters and donors’ payment methods, credit card information, addresses, phone numbers and other information vital to perform a fundraising transaction through Fun-Raise USA. The content and other information that you provide to Fun-Raise USA may be publicly accessible, such as information you post in pictures and data you have listed. We also collect information through customer support communications and other submissions, questions, comments and feedback. 

You represent and warrant that you have the rights necessary to submit the information that you have provided; you grant Fun-Raise USA a fully paid, royalty-free, perpetual, irrevocable, worldwide, non-exclusive, and fully transferable and sublicensable right and license to use, reproduce, perform, display, distribute, modify, re-format, create derivative works of, and otherwise commercially or non-commercially exploit in every manner, any and all information that you provided, and to sublicense the foregoing rights; and you irrevocably waive, against Fun-Raise USA and its users any claims and assertions of any moral rights contained in such information. 

You acknowledge and agree that Fun-Raise USA may keep your Information, as well as content, and may also disclose your information or user content if required to do so by law or in the good-faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable laws or government requests; (b) enforce these Terms of Service Use; (c) respond to claims that any user content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Fun-Raise USA, its users, employees, affiliates or the public. You are not permitted to offer any contest, reward, give-away, raffle, or any such activity, through the services of Fun-Raise USA.

Limitation of Liability

Fundraisers/fundraising organizations and their agents/fundraisers are not employees or agents of Fun-Raise USA, nor are they acting in any other representative capacity of Fun-Raise USA. Fundraisers undertake all fundraising activities on their own behalf and at their own risk.  Fun-Raise USA will not be liable for any injury, damage or loss sustained as a result of any fundraising activities. Fundraisers should note that they are not covered by Fun-Raise USA liability insurance. Any liability insurance required for fundraising, needs to be provided by the fundraiser and the fundraising organization. All other expenses associated with fundraising activities are the responsibility of the fundraiser/fundraising organization.  

FUN-RAISE USA WILL NOT BE RESPONSIBLE OR LIABLE IN ANY WAY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, LOST REVENUES OR LOST PROFITS RESULTING FROM ANY USE OR MISUSE OF THE SITE OR ANY OTHER WEBPAGE OR WEBSITE LINKED OR REFERENCED ON OR BY THE SITE.

Product(s) Liability:  Fun-Raise USA shall be liable for any products that are proven to be damaged when they were delivered to the fundraising party. All damaged products should be reported to Fun-Raise USA upon delivery from Fun-Raise USA. All damaged products should be returned to Fun-Raise USA. Any product found to be damaged after the delivery from Fun-Raise USA, its agents or affiliates, is the responsibility of the fundraising party. 

Product Delivery: A minimum of three (3) business days and a maximum of ten (10) business days after an order has been placed, shall be expected for product delivery from Fun-Raise USA to the fundraising party. 

Website and Webpage Practices: Fun-Raise USA is committed to providing you with the best resources and the most complete information possible to help your fundraising efforts prosper. As a convenience to you, Fun-Raise USA may provide products and services which include but are not limited to websites, internet resources and fundraising resources that are owned or operated by other companies, that are not otherwise affiliates of Fun-Raise USA. We provide this access through a network of companies. By using the services, you agree that the outside resources utilized by Fun-Raise USA to operate your fundraiser are necessary.

Due to the fundraising networks and practices being incorporated by Fun-Raise USA for the benefit of its fundraisers and users, Fun-Raise USA does not obtain complete control of its websites and webpages. Many of these fundraising capabilities are supplied by third party companies as part of our network. Due to this occurrence, Fun-Raise USA may not always have the most accurate information until it is displayed to them. Fun-Raise USA will make every attempt to provide accurate and up-to-date information to increase the profitability of your fundraiser. 

Fun-Raise USA is not responsible for the content or accuracy of any website or webpage that is owned and/or operated by the Fundraiser/Fundraising Organization. Fun-Raise USA offers its products and services “as is,” or on a “as available” basis. Fun-Raise USA is committed to providing you with quality online services. If you find any information on any Fun-Raise USA webpage or website that you believe to be inaccurate or have concerns, please e-mail us at fundraising@fun-raiseusa.com.

Fundraising plans (unless otherwise specified) include a webpage that conducts transactions through the Fun-Raise USA " On-line Fundraising Webstore". This e-commerce webpage has an SSL certificate and firewall protection, allowing your supporters to feel safe when making a purchase to support your cause. The products and services described in various webpages on the Fun-Raise USA website, as applicable, may only be offered in certain jurisdictions where they may be legally offered for sale or otherwise as designated by Fun-Raise USA in its sole business discretion. The Site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be restricted, prohibited or otherwise contrary to applicable law or regulation.

Organizations and Charities:  Are subject to the same Terms of Service Use as all other Fundraisers who fundraise through Fun-Raise USA.

Member Account, Password and Security: You are responsible for maintaining the confidentiality of your password and account and are fully responsible for any and all activities that occur under your password or account. You agree to: (i) immediately notify Fun-Raise USA of any unauthorized use of your password or account or any other breach of security; To avoid unauthorized use of your account close out from your account at the end of each session when accessing the services of Fun-Raise USA. Fun-Raise USA will not be liable for any loss or damage arising from your failure to comply with this section.

Privacy Policy and Security:  The Fun- Raise USA platform, its users (fundraisers) and their supporters are subject to the Fun-Raise USA and Go daddy Privacy Policy and Terms of Service. Google’s reCAPTCHA provides an added level of security for the platform.  

Third-Party Companies and Products

As mentioned, Fun-Raise USA uses third-party products and services to provide much of the innovative technology that we offer. Fun-Raise USA assumes no responsibility and disclaims all liability with regard to the selection, performance or use of these products or vendors. Fun-Raise USA, however, has thoroughly investigated the products, services and vendors we select to aid our clients in fundraising and does not intend for there to be issues with the companies that assist us in our mission to serve our fundraisers.

Fun-Raise USA has and will test all products and services that it provides regarding (it’s) quality, safety, or suitability for our clients. Fun-Raise USA assumes no responsibility or liability with regard to the performance or use of the products and services that are manufactured or produced by third parties.

Account Information

By fundraising with Fun-Raise USA you are authorizing Fun-Raise USA to transfer and/or collect monies into a safe and secure account that you and/or your organization own and legally have access to. Fun-Raise USA only issues funds from FDIC banking institutions for the safety and security of both Fun-Raise USA and its Fundraisers.

Transactions from supporters/donors can be made through your webpage and via telephone at 877-737-7656. Fun-raise USA and its agents can be reached via e-mail at fundraising@fun-raiseusa.com or 877-737-7656. 

Electronic Banking Services Terms of Use and Privacy Statement

E-Commerce webpages are issued to all fundraisers and therefore electronic transactions shall take place in the process and procedure of fundraising. The banking services utilized by Fun-Raise USA are used for the purposes of relaying commissions (revenues) to the accounts of all fundraisers. Other purposes can include receiving monies. All information involving banking and accounts shall be stored securely. If any banking or account information needs changing, notify Fun-Raise USA. Fun-Raise USA is not liable for any delays or hold-ups involving the electronic transfer of monies or revenue payouts; nor are they liable for any damage to your account from a third source. 

Communication Thru Mobile Services and Text Messages: The Fun-Raise USA platform includes features that may be made through a mobile device and includes the ability to: Upload content to the platform; browse the platform; and purchase and donate through the platform. If you access mobile services, your wireless service carrier’s standard charges, data rates and other fees may apply. If you change or deactivate your mobile telephone number, you agree to immediately update your Fun-Raise USA account information to ensure that we are sending messages or calling (contacting) the right person regarding the account.

By using the mobile services, you agree that we may communicate with you about matters related to your account by SMS, MMS, text message or other electronic means to your mobile device and that certain information about your usage of the mobile services may be communicated to us. 

As the Fundraiser, you will conduct all communication with Fun-Raise USA. You the fundraiser/fundraising agent will be the primary point of contact in case of an issue. No one else will be able to handle the finances as it pertains to your fundraising account with Fun-Raise USA. Only you as the fundraiser or fundraising agent of the organization will be able to gain or provide information or conduct any business related to Fun-Raise USA and the fundraiser(s) it establishes and/or provides.  This protects both parties from miscommunication, theft and other negative effects of unauthorized participation. All monies, documentation and other information regarding the fundraiser shall be communicated through the Fundraiser or the agent of the fundraising organization.   

INTELLECTUAL PROPERTY RIGHTS

Services Content and Trademarks: You acknowledge and agree that the Services may contain content or features that are protected by copyright, patent, trademark, trade secrets or other proprietary rights and laws. You agree not to modify, distribute or create derivative works based on the Services of Fun-Raise USA. In connection with your use of the Services you will not engage in or use any data mining, spiders, robots, scraping or similar data gathering or extraction methods. If you are blocked by Fun-Raise USA and its services, you agree not to implement any measures to circumvent this matter. You agree not to copy, modify or create a work that resembles Fun-Raise USA. The Fun-Raise USA name and logo are owned by Fun-Raise USA. Fun-Raise USA shall be the only entity using the name and logo. 

Third-Party Material: Fun-Raise USA is not liable in any way for any content or materials of any third parties including, but not limited to, any errors in any content, or for any loss or damage of any kind as a result of the use of any such User (Fundraiser) Content. Fun-Raise USA does not guarantee that it will pre-screen content but will investigate fundraisers to the best of its ability to eliminate the potential of fraud.

Fun-Raise USA has the right in its own discretion to refuse, remove, or allow any content at any time and for any reason, with or without notice, and without any liability to you or to any third party for any claims, damages, costs or losses resulting from this action.

Violation of These Terms of Use

Fun-Raise USA will not and does not share, sell or exchange you or your organization’s information to anyone except with its financial institutions, affiliates and third-party resources it uses to operate its fundraising platform. Fun-Raise USA always reserves the right to disclose any information that Fun-Raise USA believes is necessary to comply with any applicable law, regulation, legal process or governmental request and complying with all applicable laws, rules or regulations in relation thereto. Fun-Raise USA also may disclose your information when it determines that applicable law requires or permits such disclosure, including exchanging information with other companies which includes banks and other organizations for fraud protection purposes. 

You acknowledge and agree that Fun-Raise USA may preserve any transmittal or communication by you with Fun-Raise USA through its website or any service offered on or through the Fun-raise USA website, and may also disclose such data if required to do so by law or if Fun-Raise USA determines that such preservation or disclosure is reasonably necessary (1) to comply with a legal process, (2) to enforce these Terms of Service Use, (3) to respond to claims that any such data violates the rights of others, or (4) to protect the rights, property or personal safety of Fun-Raise USA, its affiliates, users of or visitors to the website, or the public. 

You agree that Fun-Raise USA may, at any time and without prior notice, terminate your access to its website and/or block your future access to the website if we determine that you have violated these Terms of Service Use or other agreements or guidelines which may be associated with your use of the website or for other causes, which includes but is not limited to (1) requests by law enforcement or other government agencies, (2) a request by you, (3) unexpected technical issues or problems (4) eliminating or modification of content of the Fun-Raise USA website or any service offered on or through the website,

Supporter/Donor Disputes: If a Supporter/Donor disputes a credit card charge for the fundraiser/donation through the Services or submits a request for a refund it will be refunded within 5 to 7 business days.

Dispute Resolution Agreement: By using the fundraising services of Fun-Raise USA you agree that any disputes between you and Fun-Raise USA can and will be resolved by binding individual arbitration and you waive your right to a jury trial or participation in a class action suit. 

To the extent permitted by applicable law, any claim or dispute related to these Terms of Service Use or your use of the website or duties under these Terms of Service Use, including the validity of the Claim, shall be settled by binding individual arbitration. Fun-Raise USA has chosen the Better Business Bureau (BBB) to administer the binding arbitration which shall be settled by both parties. However, parties may choose a different neutral arbitrator to render a final award in accordance with the applicable law. The arbitration can and shall also be governed by the laws of the United States of America and its arbitration provisions.

The rules and procedures specified in this Section are the rules and procedures for the resolution of disputes between the parties arising out of or relating to your use of the Fun-Raise USA website and its resources provided. 

The party with the dispute may request temporary remedies in a court of law that has the jurisdiction to protect goods, property or services until the agreed upon and selected arbitrator has had the opportunity to resolve the request for temporary relief. Each party is required to continue to perform its obligations under these Terms of Service Use pending final resolution of any dispute arising out of or relating to these Terms of Service Use and use of the website, products and services unless a legal situation arises that amends the circumstances.

RECORD KEEPING: 

Information and Record Retention: You acknowledge that Fun-Raise USA has no obligation to you to retain data relating to any account or fundraiser. You acknowledge that Fun-Raise USA reserves the right to delete data or to terminate accounts or fundraisers at any time and for any reason, with or without notice, and without any liability to you or to any third party for any claims, damages, costs or losses resulting therefrom. This also applies to fundraisers started by organizations/charities on the platform.

Although there is no obligation to maintain records, Fun-Raise USA does maintain records associated with the fundraiser, the fundraising party and the agent(s) that the organization provides Fun-Raise USA, to conduct business on its behalf. Fun-Raise USA also keeps the financial records of the supporters/donors who purchase through the organization’s e-commerce webpage. Any and all other information needed to perform fundraising services shall be collected and maintained by Fun-Raise USA. Fun-Raise USA does not give, sell or trade information with any parties other than those affiliated with or those that provide products and/or services to Fun-Raise USA. Financial information of the Fundraiser’s/Organization’s supporters and donors can be requested by the Fundraiser/Fundraising agent of an organization.

Time to Service: Due to resource constraints, Fun-Raise USA, its staff are only able to assist each organization with an allotted amount of time. For the fact that Fun-Raise USA is assisting other fundraisers as well, we must be fair in appropriating time to all parties we service. This allotted time allows us to service the fundraising platform, manage the delivery of products and/or services to supporters, and all other duties associated with providing an internet fundraising platform, as well as prevents any future disputes.

Theft: All theft perpetrated and/or associated with or against Fun-Raise USA, its affiliates and its Fundraisers/Fundraising Organizations will be prosecuted to the fullest extent of the law. 

The Fundraiser/Fundraising Organization agrees not to duplicate, replicate or share any of the ideas, marketing strategies or any other confidential information Fun-Raise USA shares with its Fundraisers/Fundraising Organizations. This agreement serves to protect Fun-Raise USA's sensitive and confidential information, such as computer systems, marketing and financial plans as well as other business strategies. This agreement is entered into between Fun-Raise USA and the Fundraiser/Fundraising Organization and/or its agent who agreed in signature. The Fundraiser/Fundraising Organization and Fun-Raise USA have entered into a formal agreement whereas Fun-Raise USA will perform duties related to fundraising resources. Whereas the Fundraiser agrees to the policies described herein as binding. Therefore, Fun-Raise USA and the Fundraiser agree to the following terms that are listed in this agreement.

For the entire duration of this agreement and for 1 year after the Fundraiser/Fundraising Organization's relationship with Fun-Raise USA has been terminated for any reason, the Fundraiser/Fundraising Organization will not share, express, or reveal to any other business or entity that is like or similar to, the same as or in competition with Fun-Raise USA, any of the ideas, works or ways of Fun-Raise USA. The Fundraiser/Fundraising Organization also agrees to have its agents and members follow the same policies.

Fundraisers/Fundraising Organizations may still conduct its own fundraisers without Fun-Raise USA as long as those intellectual ideas are not those of Fun-Raise USA.

DORMANT ACCOUNTS: Fun-Raise USA has the right to delete any dormant accounts. Dormant accounts are accounts that have no activity for 3 months or longer. This means that no fundraising funds were made or transferred to this account. 

Agreement Acknowledgements: The Fundraiser and/or the Fundraising Organization acknowledges that they have had the opportunity to seek legal counsel if they don't understand the Terms of Service Use (terms and conditions) of this agreement before signing this agreement. It is understood and agreed upon that the policies proposed are fair and necessary for Fun-Raise USA's operation and protection. Finally, the Fundraiser/Fundraising Organization agrees that these restrictions are reasonable and do not constitute a threat to their ability to raise funds with Fun-Raise USA. 

The products and services described on the Fun-Raise USA website may only be offered in certain jurisdictions where they may be legally offered for sale or otherwise as designated by Fun-Raise USA in its sole business discretion. The Fun-Raise USA website is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be restricted, prohibited or otherwise contrary to applicable law or regulation.

Applicable Law: This agreement and its interpretation shall be governed by the laws of Ohio as well as the United States of America. Whereas, both parties agree to these terms and give their consent and authority to this agreement. By signing, the Fundraising Party and its Agent(s) agree that they are "fit and proper” to raise money through Fun-Raise USA and its platform and do not intend to do anything that will bring Fun-Raise USA into disrepute. The Fundraising Party (as well as its Agent) understands that Fun-Raise USA may terminate its ability to raise funds as a Fundraiser (individual and/or organization) at any time for violation of Fun-Raise USA policies or the Terms of Service Use.

Severability:  If any part of this Agreement and Terms of Service Use is held invalid or unenforceable, such determination shall not affect the validity or enforceability of any other part or provision of this Agreement.

Cancellation: The Fundraiser (Fundraising Party) has the right to cancel this agreement and fundraising activities with Fun-Raise USA at any time. After cancellation the Fundraiser agrees not to access or attempt to have any fundraisers or any activities as such that have any public or private connection with Fun-Raise USA, its name, likeness or any features of the company. Fundraisers can cancel this agreement and its fundraising activities with Fun-Raise USA by calling Fun-Raise USA at 877-737-7656 or by email at fundraising@fun-raiseusa.com   

If you are the authorized representative of an organization/charity, and no longer wish to utilize our services (platform) you may contact us at fundraising@fun-raiseusa.com or 877-737-7656. The email should include the organization’s full name, your full name, title, and an email address and phone number associated with the organization. When your organization is removed from the Fun-Raise USA’s database, it will no longer be eligible to receive monies or maintain a webpage through the Fun-Raise USA Platform.

Your use of this site verifies that you grant Fun-Raise USA the ability to help you fundraise or support/donate to a fundraiser. You assume all responsibility for the operation of the fundraiser or the support that you offer to the fundraiser..  

You acknowledge that Fun-Raise USA is not selling items on behalf of any fundraiser, but in fact, providing a platform where those who fundraise can fundraise products and receive donations. Your use of the site signifies that you are aware of these matters and agree to all of the Fun-Raise USA Fundraising Platform Terms of Service .
